This website (this "Site") is provided by LifeAt LLC ("LifeAt" or "we" or "us") as part of a program of services (collectively, the "Service") designed to help participating residents ("Residents") of select apartment buildings, condominiums and residential communities enhance their residential experience, and also to help prospective tenants or buyers find open units at these buildings. Your privacy is important to us. This privacy policy has been created to let you know how we gather information on this Site and in the course of providing the Service generally, and how we may use that information and share it with others. By accepting this privacy policy, you are authorizing LifeAt to gather, use, and disclose your information in the manner described below. Table of Contents
1. The Information We Gather, and How We Use It. A. Username and Password: The Service is intended to provide Residents with a unique Network designed to help them more fully experience life at their building and the surrounding neighborhood. To receive the Service, you must first register as a Resident on this Site. If you are a Resident of a building, we will permit you to access the entire Network for that building by using a username and password. Initially, LifeAt will provide you with a temporary username and password in a postcard or other mailing sent to your unit or, in certain participating buildings, provided by your building's management. If you live with a roommate who has already registered at LifeAt, you may ask him or her to request an account for you through the Site. Otherwise, you may request a temporary username and password from LifeAt by e-mail to info@lifeat.com. When you register to access the Network, we will ask you to provide your e-mail address and to select a new password of your choosing. Your e-mail address will then be used as your username for login purposes, but will never be displayed to other users. We will use your username and password to control access to the Site. Your username and password will be required in order to access your information via the Site, including any messages sent to you by other Residents. You are responsible for keeping your password confidential, and you should never disclose your password to others. Please notify us immediately of any unauthorized use of your password or account by e-mailing us at support@LifeAt.com. B. Additional Registration Information: In addition to your e-mail address (which will double as your username) and password, LifeAt will ask you to provide certain personally identifying information when you first register to receive the Service as a Resident. This information may include your name, address, fax or telephone number, or other information concerning your personal identification. (You will also be invited to provide general profile information described under "Your Profile" below.) We will use this information to make sure that you get access to the right Network. For example, we may use your name and address to verify that you actually live at the building whose Network you wish to access. As part of this verification process, we may provide your personally identifying information to your building's management. Other than to verify your residency, we will not share your last name or other personal information with any party without your consent. Your first name will be visible on your Profile page and on any messages, listings, reviews or friend requests that you post or send through the Site. You may provide a preferred nickname instead of your actual first name, in which case your nickname will be displayed instead of your first name. We will also not share your mailing address with third parties, except in the process of verifying your registration, without your consent. That said, however, because access to your Network will be limited to residents of your building (and, if you live at a Premium Sponsored Building, certain building owners, management or staff) these people will realize that you are a resident of your building. In addition, we may provide certain aggregated data to third parties without revealing your name or unit number. For example, we may let your building's management or a restaurant in your neighborhood know the number of LifeAt users living in your building. C. Your E-Mail Address: We will use your e-mail address to send you important information about the Service (such as changes to this privacy policy or the Terms of Use). You may also opt to receive notifications when other Residents have sent you a message or friend request and, if available to your Network, the following notifications:
You may opt out of receiving any of these messages (other than messages containing important information about the Service or messages that are not yet available to your Network); see the choice/opt-out section below. D. Your Profile: You may also provide profile information such as your occupation, hometown, hobbies, and photos, as well as demographic information such as your age, gender, salary range, or marital status. Any time you post a message, review, or listing on this Site, that post will be accompanied by a link to your Profile page. Your profile information is generated by you and you only, and you can access, modify and review this information at any time and for any reason through your LifeAt account. If you'd like to add more information, or change, modify, delete, or review information previously provided, log on to this Site and go to the "My Profile" page. (If there is information that you need to change that cannot be changed through the Site, please use the contact information below to send your request.) Please bear in mind that your Profile will be visible to any person who has access to your Network. This includes any Residents of your building, and, if you live at a Premium Sponsored Building, may also include building owners, management or staff. Even though this is a limited group, once you make any information public via the Site, anyone who views the information that you have made public could use or distribute it in any manner. E. Messages; Community Forums; Neighborhood Guide, Door-to-Door, and Marketplace Sections Many Residents decide to actively use their Network to network, by adding their fellow Residents as "friends" through their Profile pages or by sending messages through the Site. Your Network also contains community areas such as general bulletin boards where you may post messages for other Residents of your building to see, Neighborhood Guide and Door-to-Door sections where you can rate, review, and recommend businesses in your neighborhood, and a Marketplace where Residents can offer goods and services to one another or post wanted ads. Please note that, if you send or post a message, review, friend request, or Marketplace listing through our Site, your first name (or nickname) will be displayed with that content, along with a link to your Profile page. In addition, as with your Profile page, once you share any information via the Site, whether through a message to one Resident or a post in a community forum or otherwise, we can not control how anyone who views your information might use or distribute it. On occasion, we may use content you post on our bulletin boards or other community areas (or any other public section of the Site, including your Profile page) for promotional purposes, in e-mail newsletters, in promotional collateral, or elsewhere, both on its own and aggregated with any other information you provide through the Site (other than your last name or contact information), and by submitting such content to the Site you agree that we may do so. You should exercise caution when deciding to disclose your personal information in these areas, since anyone - not just us - may use publicly posted information. F. Information from Prospective Residents Because certain areas of the Service are designed to help prospective Residents discover new rental or purchasing opportunities, you can express your interest in any building on the Site by going to the Network for that building and clicking the "I am interested in living at" button on the Home page. You will then be prompted to provide your name, contact information, and detail about your preferences and price range. Depending on whether LifeAt has a direct relationship with that building's management, and on the terms of any such relationship, we may contact you directly, or we may forward your information to either the building's management or to an independent broker so that they may contact you to discuss openings for rent or purchase at the building. By providing the information requested, you authorize LifeAt to share this information with such parties. In no event shall LifeAt be liable for any damages arising out of any interaction between you and such parties. G. Third Party Offers From time to time, we may inform you of special offers from certain of our partners that are identified by name ("Partners"). To participate in such offers, you may be asked to provide additional personally identifiable information. Information submitted in conjunction with an offer made by a Partner may be shared with that Partner, in which case the Partner's use of such information will be governed by the privacy policy of that particular Partner. Check the Partner's site for specifics. H. Technical Data: IP Address, Cookies, and Third Party Websites Our Site may track your IP address to help diagnose problems with our server, and to administer our Site. We may use IP addresses to help identify you and to gather broad demographic information. Note that we may also share IP addresses with legal authorities when requested, or with your employer in the event of a violation of our Participation Agreement. Our Site may also use "cookies" (small data files that are stored on your hard drive) to save your password so you don't have to re-enter it each time you visit. We do not use cookies to retrieve personal information from your computer. The cookie we give you stores your user id and tells us whether you've logged in or not. We need to know who you are so we can do things like show you your personal messages instead of showing you somebody else's. If you have your browser set to not accept cookies, then you may not be able to log in to parts of this Site. We may also use cookies to track the performance of promotions and offerings that we make available in connection with the Service. At times, advertisers on our Site may set cookies when you view their advertising banner or other forms of advertising. While we use cookies in other parts of our Site (as noted above), any information collected by cookies received with banner ads are collected by those advertisers (or their third-party ad serving company or other agents), and we do not always have access to that information. The advertiser's (and/or its third-party ad serving company's or other agent's) privacy policy will govern the use of this information, and LifeAt is not responsible for the privacy practices of such third parties. Both this Site and any e-mail that you receive from us may contain links to other websites. We are not responsible for the privacy practices or the content of such websites. As a general rule you should always look for and review a site's privacy policy before giving out any personal information. I. Consent Requirements; Aggregated Data We will not sell your personally identifiable information to third parties or mass marketers unless we explicitly get your permission to share your information with those persons. For example, if we posted an online contest or survey on the Site, we would not provide your name or e-mail address to the company sponsoring the contest or survey without first getting your permission to do so. Unless you consent to the disclosure of your personally identifiable information, only we and our affiliates, our technical consultants, third party auditors and other third parties who make the Site or Service available, enhance their functionality, or provide associated services, or who deal with you in delivering content, products, or services have access to this information. Please note that we do reserve the right to transfer your personally identifiable information and other information to our successors in business and purchasers of Site or Service assets, or in connection with any outsourcing of Site or Service functionalities. We may also disclose aggregated data to our advertisers, Sponsored Premium Buildings, Partners and other third parties to generate reports, marketing and technical research and for related business purposes. For example, we may tell advertisers how many people saw or clicked on an ad and additionally, how many people saw or clicked on ads in different portions of our Site and in different buildings included in our Service. Or we may report to real estate brokers that, on average, the Residents of buildings in your neighborhood rate the local restaurants more highly than the Residents of buildings in any other neighborhoods in your city. Where available, we may offer additional information about viewer characteristics. However, this does not include personally identifiable information about you or your online usage patterns. Our advertisers, Partners, and Premium Sponsored Buildings allow us to provide our service to you. In return, they need to know how to effectively use the Service to interact with potential customers. Also, as described above under "Information for Prospective Residents", if you request information about rental or purchasing opportunities at a given building, we may forward the information you provide to property managers or brokers so that they may contact you about such opportunities. J. Children Please note that you must be at least 18 years old to register at the Site. We will never request personal information from anyone whom we know to be under the age of 18 without verifiable parental consent. If we discover that you are under the age of 18 and have registered without verifiable parental consent, we reserve the right to remove and delete the information in your account and immediately terminate the account. Depending on the circumstances, we may also forward such information to law enforcement. 3. Choice/Opt out If we have made e-mail updates available to your Network, you will have the option to sign up for these updates when you register on this Site. You may also opt in or out of receiving the updates (if they are available) at any time by updating your preferences on the "Settings" page of the Site. 4. Improper Conduct The restrictions above will not apply in the event that you engage in certain improper conduct. Specifically, LifeAt shall have the right to itself use or release to third parties (including law enforcement and your building's owners or management) personally identifiable information regarding users who are suspected of having used this Site or any other component of the Service for any fraudulent purposes, for harassment, or for having otherwise violated any law, rule or regulation or the rights of third parties or having engaged in any conduct which LifeAt deems improper. By using the Service, you are agreeing to our use or release of any information you provide in any manner we deem appropriate or necessary if you are suspected of having engaged in any conduct which we deem improper. We are not obligated to pre-screen or monitor any messages, bulletin boards, reviews, or Marketplace listings, but do reserve the right to do so. 5. Security This site has security measures in place to protect the loss, misuse and alteration of the information under our control. We make a diligent effort to ensure that our secure server software (SSL) is the industry standard and among the best software available today for secure commerce transactions. Our SSL encrypts all of your personal information to protect the information as it travels over the Internet. We also take contractual, administrative and physical steps to protect against unauthorized access to and disclosure of individually identifiable information. If, during their employment, LifeAt employees acquire confidential or proprietary information belonging to LifeAt or its users, such information will be handled in confidence and may not be disclosed to unauthorized third parties. Please note, however, that no data transmission over the Internet is 100% secure. As a result, we cannot guarantee the security of the information that you transmit via our online services. 6. Our deletion policy Your access to the Service will terminate within thirty days if you move out of your building, and may also terminate if we have an agreement with your building management or owners that is terminated or interrupted, or if you violate our Terms of Use. If so, you will no longer be eligible to log in to access your Network. LifeAt shall have no obligation to maintain or forward any data that you have submitted. We delete our Residents' personally identifying information periodically after the termination of their accounts. You may also request that we delete your personally identifying information at any time, but you will no longer be able to use the Service once we have deleted that information. Once information that could be used to identify you has been removed, the information that remains may be used and shared by us as permitted by law. There is no scheduled date at which this non-identifying information will be destroyed or no longer used. This is because once we aggregate data as described above, we continue to use and analyze that data on an ongoing basis. 7. Your Consent By using the Service, you consent to the collection, use, and storage of your personal and non-personal information as described above. You also authorize the export of personal information and its storage and use as specified above when you provide such information to us. Our headquarters are located in Brooklyn, New York. This policy and our legal obligations are subject to the laws of New York and the United States of America, regardless of the location of any user. Any claims or complaints must be filed in the state or federal courts located in Brooklyn, New York. We may amend our Privacy Policy, but if we decide to change our Privacy Policy, we will post those changes on this page, so you can always be aware of what information we collect, how we use it and under what circumstances we may disclose it. Any changes will only apply to information collected after the change is posted. 8.
